Deepink Terms of Use

These Terms of Use (“Terms”) govern your use of:

  • the Deepink desktop app (the “App”), and
  • Deepink’s optional hosted features (for example, account login, sync, and sharing links) (the “Hosted Services”), as made available by Deepink Project (maintained by Robert Vitonsky) (“Deepink,” “we,” “us,” or “our”).

By using the App or Hosted Services, you agree to these Terms.

If you do not agree, do not use the App or Hosted Services.

2) Privacy

Our Privacy Policy explains how we handle personal data and analytics. It is part of these Terms. If there is a conflict between these Terms and the Privacy Policy regarding privacy topics, the Privacy Policy controls.


3) Open source software license (AGPL-3.0)

Deepink is open source and distributed under the GNU Affero General Public License v3.0 (AGPL-3.0).

Important: The AGPL-3.0 governs the App’s source code and your rights to use, modify, and redistribute that code. These Terms govern your use of the Hosted Services, the Deepink name/branding, and the website, and set rules for using our infrastructure.


4) Eligibility

Deepink is not intended for children under 13. By using the Hosted Services, you represent that you are at least 13 years old (or, if you are older than 13 but under the age of majority where you live, that you have permission from a parent or guardian).


5) Accounts (optional)

You can use the App without an account.

If you choose to create an account for additional Hosted Services:

  • you must provide a valid email address,
  • you are responsible for maintaining the security of your account, and
  • you are responsible for activity under your account.

We may suspend or terminate accounts that violate these Terms or that we reasonably believe are used for abuse.


6) Your content

6.1 Ownership

You own the notes and other content you create (“User Content”).

6.2 Responsibility for sharing

If you create a share link or otherwise share User Content using the Hosted Services, you are responsible for:

  • ensuring you have the rights to share it,
  • choosing whether to share it encrypted or decrypted,
  • protecting the share link from unintended disclosure, and
  • understanding that anyone with the link may be able to access the content.

6.3 Decrypted (plaintext) sharing

Deepink supports a mode where you can share a note in decrypted/plaintext form. If you choose that mode, you instruct us to host and deliver that note in readable form to recipients with the link. This may reduce confidentiality compared to encrypted sharing.


7) Acceptable use (Hosted Services and sharing)

We do not restrict what you store locally on your own computer using the App.

However, to protect the Hosted Services (including sharing links), you agree not to use the Hosted Services to:

  • share, distribute, or make available content that is illegal, fraudulent, or that violates applicable law;
  • share content that infringes another party’s intellectual property rights;
  • share content that is abusive, harassing, threatening, or that includes doxxing or non-consensual personal information;
  • distribute malware, spyware, or other harmful code;
  • exploit or attempt to exploit the Hosted Services (including scanning, probing, or bypassing access controls);
  • overload, disrupt, or degrade the Hosted Services (including scraping, automated link-guessing, bulk requests, or denial-of-service behavior);
  • use the Hosted Services to impersonate others or misrepresent affiliation with Deepink.

We may rate-limit, block, remove shared content/links, or suspend accounts when we reasonably believe it is necessary to enforce these Terms, comply with law, or protect the Hosted Services and other users.


8) Your feedback

If you provide suggestions or feedback, you grant us the right to use it without restriction or compensation, and without any confidentiality obligation.


9) Deepink name, logo, and branding

The App’s source code is licensed under AGPL-3.0, but the Deepink name, logo, and other branding are not automatically granted for your use.

You may truthfully state that your fork/build is “based on Deepink” or “built from Deepink (AGPL-3.0),” but you may not:

  • present your fork as the “official” Deepink product, or
  • use Deepink branding in a way that implies endorsement or affiliation, unless you have our permission.

10) Service availability and changes

The Hosted Services may change over time. We may add, modify, or discontinue any part of the Hosted Services at any time.

We will post updates to these Terms on our website. Your continued use after changes take effect means you accept the updated Terms.


11) Termination

You may stop using the App and Hosted Services at any time.

We may suspend or terminate your access to Hosted Services (including accounts, sync, and sharing) if:

  • you violate these Terms,
  • we reasonably believe your use is abusive or harmful, or
  • we are required to do so to comply with law.

Termination of Hosted Services access does not affect your local data stored on your device.


12) Disputes (informal resolution first)

If you have a dispute or concern, please contact us at [email protected]. You agree to try to resolve disputes informally with us first.

We do not include an arbitration clause in these Terms.

(We intentionally do not specify a governing law or exclusive venue in these Terms.)


13) Disclaimers (“AS IS”)

To the maximum extent permitted by law:

  • The App and Hosted Services are provided “AS IS” and “AS AVAILABLE.”
  • We disclaim all warranties and conditions of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
  • We do not warrant that the App or Hosted Services will be uninterrupted, error-free, secure, or free of harmful components.
  • You are responsible for safeguarding your password and encryption keys. If you lose them, you may lose access to encrypted data.

Some jurisdictions do not allow certain disclaimers, so some of the above may not apply to you.


14) Limitation of liability (no numeric cap)

To the maximum extent permitted by law:

  • Deepink will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenues, business, goodwill, or data, even if we have been advised of the possibility of such damages.
  • Deepink’s total liability for any claim will be limited to direct damages actually proven.

Some jurisdictions do not allow certain limitations of liability, so some of the above may not apply to you.


15) Indemnity

To the maximum extent permitted by law, you agree to indemnify and hold harmless Deepink from and against claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to:

  • your use of the Hosted Services,
  • content you share via the Hosted Services (including decrypted sharing),
  • your violation of these Terms, or
  • your violation of any rights of another person or entity.

The App or website may reference or link to third-party services. We do not control and are not responsible for third-party services. Your use of third-party services is governed by their terms and policies.


17) Miscellaneous

  • If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect.
  • These Terms are the entire agreement between you and Deepink regarding the App and Hosted Services, except where the AGPL-3.0 license governs the software code.
